The District Attorney of San Joaquin County began this civil action in the name of "The People of the State of California" against the Centr-O-Mart, a corporation, and certain individual defendants, to enjoin alleged violations of the Unfair Practices Act (Bus. & Prof. Code, §§ 17000-17101.) The defendants interposed a demurrer and motion to dismiss the complaint upon the ground that the state was not a proper party plaintiff. The trial court made an order sustaining the demurrer without leave to amend and a judgment of dismissal of the action was thereupon entered.
